Acceptable Use Policy

This Acceptable Use Policy ("AUP") governs your use of the services provided by Interconnecx LLC ("Company", "we", "our", "us"). By using our services, you agree to comply with this AUP.


1. Purpose

This AUP is designed to protect Interconnecx LLC, our customers, and the Internet community from irresponsible or illegal activities. Violation of this AUP may result in suspension or termination of your services.


2. Prohibited Activities

You may NOT use our services for any of the following:

2.1 Illegal Activities

  • Any activity that violates local, state, national, or international law
  • Distribution of pirated software, movies, music, or other copyrighted materials
  • Hacking, cracking, or unauthorized access to computer systems
  • Distribution of viruses, malware, or other malicious software
  • Phishing, identity theft, or fraud

2.2 Spam and Unsolicited Communications

  • Sending unsolicited bulk email (spam)
  • Operating email lists without proper opt-in procedures
  • Harvesting email addresses from websites or other sources
  • Operating open mail relays or proxies

2.3 Network Abuse

  • Port scanning or security scanning without prior authorization
  • Denial of Service (DoS) or Distributed Denial of Service (DDoS) attacks
  • Interference with service to any user, host, or network
  • Forging packet headers or other identification information
  • Cryptocurrency mining without prior written approval

2.4 Offensive Content

  • Child pornography or sexual exploitation of minors
  • Content that promotes violence, terrorism, or hatred
  • Content that infringes on intellectual property rights
  • Defamatory, libelous, or threatening material

2.5 Resource Abuse

  • Excessive CPU usage that impacts other customers
  • Excessive bandwidth usage beyond your service plan
  • Running services that violate our Terms of Service
  • Using our network to attack other networks or systems

2.6 Other Prohibited Uses

  • Proxy services or VPN services (unless explicitly allowed in your plan)
  • Tor exit nodes
  • Adult content hosting (unless explicitly allowed in your plan)
  • File sharing or torrent tracking (unless explicitly allowed)
  • IRC bots or bouncers (unless explicitly allowed)

3. Reporting Violations

If you become aware of any violation of this AUP, please report it immediately to:

4. Investigation and Enforcement

4.1 Investigation

We reserve the right to investigate suspected violations of this AUP. This may include:

  • Monitoring bandwidth usage and server resources
  • Reviewing content on your server (when legally permitted)
  • Cooperating with law enforcement agencies
  • Gathering information from complainants

4.2 Enforcement Actions

Depending on the severity of the violation, we may take the following actions:

  • Warning: First-time minor violations may result in a warning
  • Suspension: Temporary suspension of services pending investigation
  • Termination: Immediate termination for severe or repeated violations
  • Legal Action: Referral to law enforcement for illegal activities

4.3 No Liability

We are not liable for any damages resulting from our enforcement of this AUP, including suspension or termination of services.


5. Third-Party Content

You are responsible for all content and activities on your server, including:

  • Content uploaded by your users or customers
  • Email sent through your server
  • Applications and scripts running on your server
  • Security of your account credentials

You must:

  • Monitor your server for policy violations
  • Respond promptly to abuse complaints
  • Maintain adequate security measures
  • Keep your software and systems updated

6. Security Requirements

You agree to:

  • Use strong passwords for all accounts
  • Keep your systems patched and updated
  • Install and maintain adequate security software
  • Not share your login credentials
  • Immediately report any security breaches

We reserve the right to:

  • Require password changes
  • Implement additional security measures
  • Suspend accounts with security vulnerabilities

7. Bandwidth and Resource Usage

7.1 Fair Use

"Unmetered" or "unlimited" bandwidth plans are subject to fair use policies:

  • Must be used for normal website or application hosting
  • Must not impact other customers' services
  • May be subject to traffic shaping during peak hours

7.2 Excessive Use

We may contact you if your usage is excessive or unusual. Continued excessive use may result in:

  • Upgrade to a higher service plan
  • Traffic throttling
  • Service suspension or termination

8. Backups

While we maintain infrastructure backups, you are responsible for:

  • Maintaining your own backups of your data
  • Testing backup restoration procedures
  • Ensuring data recovery capabilities

We are not responsible for data loss under any circumstances.


9. Compliance with Laws

You must comply with all applicable laws, including but not limited to:

  • DMCA: Respond to valid copyright takedown notices
  • CAN-SPAM: Comply with anti-spam regulations
  • GDPR: Protect personal data of EU residents
  • CCPA: Protect personal data of California residents
  • COPPA: Do not collect data from children under 13

10. Cooperation with Law Enforcement

We will cooperate with law enforcement agencies investigating illegal activities. We may:

  • Provide account information in response to valid legal requests
  • Preserve data for investigation purposes
  • Testify in legal proceedings if required
  • Report suspected illegal activities to authorities

11. Changes to This AUP

We may update this AUP at any time. Significant changes will be communicated via:

  • Email to your registered email address
  • Notice in our client portal
  • Update to our website

Continued use of our services after changes constitutes acceptance of the updated AUP.

13. Severability
